As most of you know, Article 21 of the contract allows you to remove negative material from your file after three years. Last week, UFT Solidarity member Francesco Portelos discussed “Spring Cleaning” your school personnel file on educatorfightsback.org
We are at the point that three years have passed since teachers started being rated under the Advance HEDI evaluation system. Sometimes the Danielson Framework for Teaching has worked to support teachers, and other times it has been used against them, with a big splash of subjectivity. Did you know that it isn’t just disciplinary files you can have removed? You can also have negative disciplinary files removed. See this UFT Article here that states “…if the observation report is not used to support disciplinary charges for three years, you have the right to remove it permanently from your file.” http://www.uft.org/print/our-rights/know-your-rights/classroom-observations
- Ask your administration to schedule a time to review your personnel file.
- Take out negative files, including observation reports, older than three years from that date.
- We are told that the Advance system keeps all your observations digitally. We are looking to get information from the UFT on removing the observations from the system as well. It appears this may violate our contract if they do not remove the reports from the Advance system.
IF YOU DON’T, THAN THOSE OBSERVATIONS CAN BE USED AGAINST YOU AND POSSIBLY LEAD TO TERMINATION DUE TO ALLEGED INCOMPETENCE!
